LEGAL ASSISTANCE FOR SENIORS
2012 South Carolina Senior Citizen's Handbook - A guide to laws and programs affecting senior citizens published by the South Carolina Bar Association.
GETTING LEGAL ASSISTANCE
Help may be available for seniors who need legal assistance. If you are 60 years old or older and low income, you may qualify for free legal help if you have a legal concern about:
-
Income protection (example: bankruptcy, appeal denials of
pension, etc.)
-
Health Care (example: appeal disability or Medicare/Medicaid
denial)
-
Long Term Care (example: facility involuntary transfer,
inappropriate discharge)
-
Nutrition (example: if benefits denied and a legal appeal is
required)
-
Housing (example: eviction or discrimination issues)
-
Utilities (not applicable in SC)
-
Protected Services (example: conservatorships)
-
Guardianship (example: obtaining or defending you from
guardianship)
-
Abuse (example: legal assistance to victims of NON-CRIMINAL Neglect situations who are not in long term care facilities)
-
Exploitation
Help is available on a first-come, first-served basis as long as we have funding to meet the need. We will still try to provide assistance information and we will refer callers to providers for assistance after funding is exhausted, but services may not be available, depending on the specific situation.
Some legal actions may not require an attorney. For example, if you want to get a divorce and there is no property involved, there are no children or custody or support issues, and there is no contest to the divorce, you may be able to file on your own. To obtain forms, click http://www.sccourts.org/forms/indexSRLdivorcepacket.cfm to visit the SC Judicial Website.
If you need a referral for legal services, look at the list below for your area.
If you are low income and not yet 60 or older or need legal assistance with a problem concerning Consumer & Bankruptcy, education, employment, family law, federal income tax, housing, migrant farm workers, probate (estates, wills), or public benefits, call directly to SC Legal Services.
